Last Updated: November 26, 2013

This website is owned and operated by OtherLevels Inc. (referred to as “OtherLevels”, “we”, “our”, and “us”). We understand that you, our customer (“you”, “your”, or “Customer”) and your end users (“End Users”) take your privacy seriously, as do we.
We collect certain information through our website, located at (our “Website”). This website privacy policy (this “Privacy Policy”) explains how each Customer’s information and End User information is collected, used, and if applicable, disclosed by us.

By using our Website, you agree to this Website Privacy Policy.

At the time our Customers first access our Website, we may request information, including names, email addresses and passwords, and related landline or cell phone numbers (personally identifiable information or “PII”) to create a Customer account. We use such information to manage each Customer’s accounts. We place email links on the Website to allow our Customers to contact us directly.

Specifically, OtherLevels may use PII for the following general purposes: (1) to fulfil Customer requests; (2) to improve our Website; (3) to contact you to resolve problems; (4) to send our Customers information about OtherLevels, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages; (5) to communicate with Customers about products and services offered by us; (6) to conduct research; and (7) to make the Website easier to use by reducing the need for our Customers to enter information.

OtherLevels provides information to our Customers about how End Users use their mobile applications as well as how certain applications are performing across different types of mobile phones. If our Customers embed OtherLevels’ libraries into End Users’ mobile application, we obtain such information as a result of data being sent to our servers from those software libraries. The data collected by the libraries may include such identifiers (in case of push messaging or otherwise), as required to identify the combination of the application of the device for purposes of either driving delivery or tracking push messages.

In addition, OtherLevels’ libraries may collect the following data if our Customers elect to collect and provide such data to us: User ID (for your service), latitude and longitude tag data, events and other usage information. Finally, OtherLevels is able to identify the IP address, device type, locale and time zone of the End User through the HTTP request. OtherLevels solely uses this data to measure effects on Customer’s messaging campaigns and to provide you with segmenting information with respect to your End Users.

OtherLevels collects Customers’ End User data in order to present you with analysis of your applications. OtherLevels may use, create derivative works of, distribute and otherwise exploit anonymous, aggregate usage data derived from the visitor interactions of our Customers (“Usage Data”), which usage shall include but not be limited to the aggregate number of transactions that occur for each Customer. However, our Customers may opt-out of having End User data included in the benchmark data. In the course of such usage,

OtherLevels will use all reasonable commercial efforts to ensure that any of Customer’s End User PII (such as any email addresses or mobile phone numbers), as well as identifying features of the Customer are removed from the Usage Data before OtherLevels utilizes the Usage Data for the purposes stated above. We do not use our Customer-identifiable data for any reason, including advertising.

Our Website servers gather your IP address to assist with the diagnosis of problems or support issues with our services. We gather information in the aggregate only and such information cannot be traced to an individual Customer.

In order to provide our Customers with a personal level of service, OtherLevels uses “cookies” to keep and occasionally track information about Customer’s visits to the Website. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. Most web browsers are set to accept cookies. If you do not wish to receive any cookies, you may set your browser to refuse cookies. In some instances, this may mean you will not be able to take full advantage of parts of the Website.

We set a persistent cookie to store your password if you choose “auto login”, so you don’t have to enter it more than once. Cookies do not of themselves personally identify End Users. The cookies simply operate as a unique identifier that helps us to know what our Customers find interesting and useful on our Website, almost like a continuing questionnaire. We do not link this information back to other information that you have provided to us.

We may also collect information using web beacons. Web beacons or “gifs”, are electronic images that may be used on our Website or in our emails. We use web beacons to deliver cookies, count visits and to determine if an email has been opened and acted upon.

While these third parties may have access to your PII in connection with the performance of services for OtherLevels, such third parties will not be permitted to use such information for any purpose other than providing their services to OtherLevels.

You may provide us with information directly, such as through subscribing to email lists, registering with us, or identifying yourself when using our services. The amount of information we collect about you depends on how you use our Website or our services.

We may also share aggregated or anonymized information in a form that does not directly identify you or your End Users with any third parties.

Unfortunately, no data transmission over the internet can be guaranteed to be totally secure and we cannot guarantee the security of PII. For example, your PII may be affected by actions outside of our control, such as computer “hacking” and physical theft. By using our Website, you acknowledge and agree that we make no such guarantee, and that you use our Website at your own risk.

In addition, our employees and the contractors who provide services related to our information systems are required to respect the confidentiality of any PII held by us. However, we will not be held responsible for events arising from unauthorized access to your PII.

If you or your End Users are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information and permitting the transfer of information, including PII, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. and the use and disclosure of information about you and your End Users, including PII, as described in this Privacy Policy.
